Diazinon: Updating List of Supported and Non-Supported Users

Please find a file attached (below) that contains an updated information sheet on Diazinon Uses and Cancellation Information. In our initial version that was sent out to commodity groups, we had included Veterinary (Cattle and Sheep) as a maintained use. Please note that the sheep uses are for import tolerances only while the cattle use is limited to eartag use on nonlactating cattle. Also, in the initial info sheet that was sent out, we listed Brassica Leafy Vegetables. In this version, the Brassica Leafy Vegetable crops cover are listed.

Diazinon Update as of February 1, 2001

LIST OF USES BEING RETAINED AND USES PROPOSED FOR CANCELLATION

HOW DID WE GET HERE: The initial FQPA review of Diazinon has been completed by EPA. The review culminated with the signing of a Memorandum of Agreement between EPA and Diazinon Producers/Data Holders — Makhteshim Chemical Works and Syngenta. The Diazinon Technical Briefing on December 5, 2000 followed the Agreement signing.

Under this agreement, Indoor Uses and Non-Ag Outdoor Uses will be phased out. However, all Agricultural Uses have passed the initial FQPA review. Diazinon will now return to the Re-registration process where issues such as applicator exposure will be addressed. Additionally, the product must undergo the cumulative risk assessment with other organophosphates.

Makhteshim-Agan is committed to the Diazinon Business in the US and throughout the world. Diazinon is a valuable, effective and safe product in the US Agricultural markets. The Company commitment to Diazinon is exhibited by recent substantial investments in production facilities. Makhteshim-Agan will continue to generate health and safety data to support Diazinon and ensure that it remains available to the US grower.

As outlined in the January 10, 2001 Federal Register Notice (Vol. 66, No. 7, pages 1977-1981),
EPA is proposing that all of the agricultural uses listed below be canceled.

EPA is allowing a 30-day comment period for user groups affected by the cancellation. In the notice, EPA suggests commenters address the following:

  1. Explain your views about the proposed cancellations as clearly as possible.
  2. Describe assumptions used.
  3. Provide copies of any technical information and/or data you used to support your views.
  4. If you estimate potential burden or costs, explain how you arrived at the estimate.
  5. Ensure your comments are received by February 9, 2001 and identify the docket control number assigned to this notice. (See the Attachment at the end of this update.)

If any of the crops on the proposed cancellation notice are important to you, please submit comment letters to EPA. Let them know how canceling a crop will affect your ability to manage your business.

Please refer to the next page for information about who to address your letter to and where to send it.

Thank you to all who have written comment letters in response to the January, 10, 2001 Federal Register Notice announcing use cancellations of diazinon.

It has come to our attention that some of the letters are missing important references to the docket, and consequently, EPA will not receive the letters.

The "rules" for submitting comment letters are as follows:

  • Comment letters must be received on or before February 9, 2001.

  • In the subject line on the first page of the letter, reference:
